On Monday, the United States Supreme Court rejected a motion to fast track a review of the constitutionality of the Affordable Care Act put forward by Virginia State Attorney General Ken Cuccinelli. Seen as a long shot by many legal scholars, Cuccinelli’s request would have moved the case to the Supreme Court’s agenda later this year, rather than moving through the normal appeals court process.
The ruling means the Supreme Court is unlikely to view the constitutionality of the Affordable Care Act until early 2012, at the earliest. The Obama Administration opposed the fast track motion. The rejection allows individual states and the Department of Health and Human Services to continue implementing the controversial law’s provisions while waiting for the courts’ ruling. More
